Everwell Wellness, LLC does not direct or control the independent clinical judgment of licensed healthcare professionals.
Treatment decisions, including whether a medication, laboratory test, treatment program, or other healthcare service is medically appropriate, are made by the applicable licensed healthcare provider.
7. Telehealth Services
Certain consultations or healthcare services may be provided through telehealth or other remote communication technology.
Telehealth may involve electronic communications between you and a healthcare provider located in a different physical location.
By participating in telehealth services, you understand that:
- Telehealth is not appropriate for every medical condition;

Prescription medications are not automatically provided merely because you complete an intake form, pay for a consultation, request a particular medication, or participate in a wellness program.
A prescription will be issued only when an appropriately licensed healthcare provider determines, following an appropriate clinical evaluation, that the medication is medically appropriate.
Not every individual will qualify for prescription treatment.
Healthcare providers may decline to prescribe, discontinue treatment, modify treatment, require laboratory testing, request an in-person evaluation, or recommend another course of care based on their professional judgment.
9. Compounded Medications
Certain treatment plans may involve compounded prescription medications when prescribed by a licensed healthcare provider and dispensed by an appropriately licensed pharmacy.
You understand that:
- Compounded medications are prepared for individual patient needs when clinically appropriate;
- Compounded medications are generally not reviewed or approved by the U.S. Food and Drug Administration (“FDA”) in the same manner as FDA-approved drug products;
- A healthcare provider determines whether use of a compounded medication is medically appropriate;
- Availability of compounded medications may change based on applicable law, regulation, pharmacy availability, supply conditions, or clinical considerations; and
- EverWell Wellness does not guarantee continued availability of any particular compounded medication.
If prescribed, medications may be dispensed or shipped by a state-licensed pharmacy in accordance with applicable laws and regulations.
10. No Guarantee of Results
Individual responses to wellness programs, medical treatments, weight-management programs, medications, peptide therapy, body-contouring services, nutrition changes, and other services vary.
EverWell Wellness does not guarantee any particular medical, aesthetic, weight-loss, body-composition, wellness, or other outcome.
Testimonials, photographs, case studies, examples, or descriptions of individual experiences appearing on the Site are illustrative only and are not guarantees that you will achieve the same or similar results.
Your results may differ based on numerous factors, including medical history, adherence, genetics, lifestyle, medications, diet, activity, and other individual circumstances.
11. Eligibility and Accuracy of Information
You agree to provide information that is accurate, complete, and current when interacting with EverWell Wellness or any healthcare provider involved in your care.

Healthcare services, medications, compounded products, treatment programs, and other offerings may also change due to:

Nothing on the Site guarantees the continued availability of a particular service, treatment, provider, medication, dose, or product.

26. Governing Law
Except where federal law or another applicable law controls, these Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
To the extent a dispute concerning use of the Site may lawfully be subject to a contractual venue provision, the parties agree that such proceedings will be brought in an appropriate court located in Charleston County, South Carolina.
Nothing in this provision overrides mandatory jurisdiction, venue, healthcare, consumer-protection, or other rights that cannot lawfully be waived.
27. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.
The remaining provisions will remain in full force and effect.
28. No Waiver
Failure by Everwell Wellness, LLC to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.

29. Entire Agreement Regarding Website Use
These Terms, together with the Privacy Policy and any other policies expressly incorporated into them, constitute the agreement between you and Everwell Wellness, LLC regarding use of the Site.
Separate agreements, informed consents, financial policies, treatment documents, telehealth consents, and other healthcare documents may govern specific healthcare services and will remain separately enforceable according to their terms.
